(GSM Insider) - Judge Rejects Apple’s Appeal Against Samsung For Sales Ban On The Galaxy Nexus.

In October last year, Judge Lucy Koh dismissed the Apple's claim on sales ban of Samsung Galaxy Nexus. But Apple decided to appeal the decision and brings the case to the Federal Circuit Court of Appeals to revisit the sales ban of Samsung Galaxy Nexus. 

According to Reuters, the court rejected Apple's request without any explanation or any published dissents. With this decision, Samsung can continue to sell the Samsung Galaxy Nexus in the United States. But it remains unsure whether Apple will appeal again at the Supreme court.

Apple vs Samsung second lawsuit will start on March 2014.

(GSM Insider) - LG Display Seeks For Injunction On Samsung Galaxy Note 10.1 Sale In Korea

The introduction of Samsung Galaxy Note 10.1 brings more attention from rivals than the consumers in the market. Apple was the first company that added this 10.1-inch display tablet to its long list of copyright infringed devices. 


According to Dow Jones report, LG Display seeks for the ban on this Samsung Galaxy Note 10.1 tablet as well. LG Display is second company that going after this tablet with stylus. LG Display seeks for injunction on this Samsung Galaxy Note 10.1 and seeks for compensation at the same time. The compensation amount is $1 million for each day the tablet on sale in Korea.

Samsung response to the claims and suggested that it is "unjustified claims" after all. More comments expected to coming soon from Samsung and LG Display. 

In the past, Samsung sued LG for infringed seven patents on its LCD products.

Nokia Sues HTC For 32 Patents Infringement,

(GSM Insider) - In the past, Nokia was not a player in the smartphone market that used to sue people for patents. But seems like the things had change for Nokia as it adopted the policy to sue other companies that infringed its patents.


Recently, Nokia decided to sue HTC in the court by accused HTC infringed 32 patents. Those patents included that connectivity and wireless patents. 

The first hearing is on 21 November 2012 and should continue until next year. 

Seems like Nokia is getting back stronger with the current position. If Nokia does not own high winning rate, will they sue HTC?

Samsung Not Interested To Settle With Apple In Patents Lawsuit

(GSM Insider) - Seems like Samsung is not going to follow the footsteps of HTC and settle with Apple on the patents lawsuit. HTC and Apple reached agreement on next week on the patents issues for next 10 years.


According to AFP, Samsung has to intention to settle with Apple. At least we knew that in the near future, there will be no settle down for both leading smartphone makers. 

This is definitely no settle inside court and outside court as well. When next year arrives, there will be another huge battle of smartphones and tablets from both companies. Just imagine when Samsung Galaxy S4 takes on the iPhone 5S. The competition must be fierce after recent rivalries. 

In Q3 2012, Samsung Galaxy S3 successfully surpassed the iPhone 4S as the best selling smartphone around the world. Although the iPhone 5 set to get the throne back in Q4 2012. So it is interesting to see how Apple going to react at the upcoming iPhone. 

In other hands, it is interesting on the Samsung as well. The main issue is definitely on the Samsung Galaxy S4. Is the upcoming flagship from Samsung going to dominate the Android world, again? Or there will rise of other manufacturers? Just look at the sales of LG Nexus 4. You surely dont want to rule out LG as well. 

No settlement means no peace agreement between both Apple and Samsung. Whether the upcoming Samsung devices will again involve in the lawsuit is also interesting to look on in the near future.

HTC And Apple Reached Global Settlement On Current And Future Patents For 10 Years

(GSM Insider) Earlier today, both HTC and Apple reached "global settlement" on the recent patents disputes between both companies. It is certainly a good news for both companies at least for the future 10 years.


Here are the press release from both Apple and HTC:

TAIPEI, Taiwan and CUPERTINO, California—November 10, 2012—HTC and Apple® have reached a global settlement that includes the dismissal of all current lawsuits and a ten-year license agreement. The license extends to current and future patents held by both parties. The terms of the settlement are confidential.

“HTC is pleased to have resolved its dispute with Apple, so HTC can focus on innovation instead of litigation,” said Peter Chou, CEO of HTC.


“We are glad to have reached a settlement with HTC,” said Tim Cook, CEO of Apple. “We will continue to stay laser focused on product innovation.”


This is certainly a smartphone move from both Apple and HTC. Recently, Samsung just lose the case against Apple and required to pay $1billion compensation. Both parties do not stated on the fees that they agreed.

From recent financial report of HTC, they certainly does not wish to get fine on such amount since their profits are not great. 

With this settlement, both companies are able to focus on own smartphone development at least for the future 10 years ahead.

Samsung Claims Apple's iPhone 5, iPad and iPod Infringe Its Patents, Court Hearing at 2014

(GSM Insider) - We knew that Samsung loss to Apple in the recent lawsuit and needed to pay $1 billion compensation for Apple as the court ruled that Samsung infringed multiple patents of Apple. And now, Samsung are going to war with Apple as it claims Apple's iPhone 5 infringes its patents.

According to latest reports, Samsung said Apple iPhone 5 infringes six design patents and one pair of standard patents. Samsung added iPad and iPod infringed other related patents as well.

“We have always preferred to compete in the marketplace with our innovative products, rather than in courtrooms. However, Apple continues to take aggressive legal measures that will limit market competition. Under these circumstances, we have little choice but to take the steps necessary to protect our innovations and intellectual property rights.” – Samsung

Apple Adds Samsung Galaxy S3, Galaxy Note And Galaxy Note 10.1 Into The List of Infringed Patents' Products





(GSM Insider) - In the recent lawsuit, Apple won the case against Samsung. As a result, court demands Samsung to pay $1 billion of damages to Apple as the compensation for illegally copied Apple products. During that time, more than 15 Samsung devices copied Apple products. And now, Apple set to add more devices into the long list. 

Apple adds Samsung Galaxy S3 and Verizon Galaxy Nexus into the list. Moreover, Apple also accused Samsung Galaxy Note and Samsung Galaxy Note 10.1 infringed their patents as well. All these devices are running on Android 4.0 ICS and below. 

Apple stated that Samsung infringed 81 patents that cause massive losses to the company. Apple accused Samsung selling infringed patents' products to the market and keep on release those illegal product like Samsung Galaxy S3. Majority of those devices are said to copy from iPads and iPhones.

Samsung Wins Over Apple In Japan Lawsuit

HTC Chairman: We Have No Plans To Settle With Apple



(GSM Insider) - The courts become more and more interesting soon. After the lawsuit of Apple vs Samsung, the next one coming soon could be the Apple vs HTC. And now, HTC Chairman finally speaks on the lawsuit involves them with Apple.

"We really are not," HTC Chairman Cher Wang stated during a local event. 

Wang also added that OEMs are not back from Android because every company has good innovations.

FAKE NEWS: Samsung Does Not Pay Apple With 30 Trucks Full Of 5 Cents Coins

This morning more than 30 trucks filled up with coins of 5 cents arrived at Apple’s headquarters in California. Initially, the security company that protects the facility said it was diverted to the wrong place, but minutes later, Tim Cook (Apple CEO) received a call from Samsung CEO explaining that they will pay $1 billion dollars for the fine recently ruled against the South Korean company in this way.

the funny part is that the signed document does not specify a single payment method, so Samsung is entitled to send him to the creators of the iPhone its billion dollars as they deem best.

This dirty but genius geek troll play is a new headache to Apple executives in the sense of the method that they need to apply for counting all that money, check if it is complete and try to deposit it crossing fingers to hope a bank will accept to receive that.

Lee Kun-hee, Chairman of Samsung Electronics, told the media that his company is not going to be intimidated by a group of “geeks with style” and that if they want to play dirty, they also know how to do it.

You can use your coins to buy refreshments at the little machine for life or melt the coins to make computers, that’s not my problem, I already paid them and fulfilled the law.

Google: Most of The Infringed Patents by Samsung Are Not Related To Android



(GSM Insider) - The court ordered Samsung to pay for $1 billion of damages for Apple as the compensation of infringed Apple's patents. While the Apple CEO Tim Cook said that the victory is more about the values. And now Google that providing Android operating system to Samsung speaks.

The court of appeals will review both infringement and the validity of the patent claims. Most of these don't relate to the core Android operating system, and several are being re-examined by the US Patent Office. The mobile industry is moving fast and all players — including newcomers — are building upon ideas that have been around for decades. We work with our partners to give consumers innovative and affordable products, and we don't want anything to limit that. - Statement from Google.

From this statement, seems like Google distinguishes themselves from the responsible related to Samsung in the lawsuit. Google clearly stated that those devices that infringed Apple's patents are not related to Android. They added that they providing Android to the partners and let them to use without limit. Perhaps this hints that they are not responsible for any patents infringement.

Tim Cook: Apple's Victory Over Samsung Is More About Values





(GSM Insider) - We said again, Apple scores a win over Samsung in the lawsuit. The court orders Samsung to pay $1 billion compensation of damges to Apple in order to solve the patents lawsuit.

With the win over Samsung, no other than Apple CEO Tim Cook is the happiest person in the Apple. Apple's staff reveals Tim Cook email at below: 

Today was an important day for Apple and for innovators everywhere. 

Many of you have been closely following the trial against Samsung in San Jose for the past few weeks. We chose legal action very reluctantly and only after repeatedly asking Samsung to stop copying our work. For us this lawsuit has always been about something much more important than patents or money. It’s about values. We value originality and innovation and pour our lives into making the best products on earth. And we do this to delight our customers, not for competitors to flagrantly copy.
